T he Poor Law Amendment Act of1834 - An Act for the Amendment and better Administration of the
Laws relating to the Poor in England and Wales (4 5 Will IV c. 76) aimed to deter the able-bodied
but provide a refuge for the ailing and the helpless. It was based on the belief that the deserving and
the undeserving poor could be distinguished by a simple test: anyone prepared to accept relief in the
repellent workhouse must be lacking the moral determination to survive outside it. (b)

buiten zo'n instituut verdient, dat zal de luilakken leren! Zorg er verder voor dat alle andere vormen van hulp

Voor de gevallen vrouwen was ook zo'n eenvoudige oplossing bedacht. Aangezien de vaders toch niet of
nauwelijks meer vielen te traceren, moesten de moeders maar op de blaren zitten. Als je van te voren maar
duidelijk maakte dat de vrouw zelf in grote moeilijkheden zou komen, dan zouden ze vanzelf ook wel
voorzichtiger in het aangaan van een seksuele relatie.
A Bastardy Clause in the 1834 Act made all illegitimate children the sole responsibility of their
mothers until they were 16 years old. If mothers of bastard children were unable to support
themselves and their offspring, they would have to enter the workhouse; the putative father became
free of any legal responsibility for his illegitimate offspring. Not only did this remove the not
infrequent problem of disputed fatherhood, but it was envisaged that the measure would discourage
women from entering into profligate relationships, (b)
The 1834 Act received much criticismincluding even from The Times which on 30th April 1834
(prior to its enactment) claimed that bill would "disgrace the statute-book.Within weeks of its
opening, the first new workhouse built under the new law at Abingdon was in the news when its
master had been the subject of a murder attempt.
In 1841, GR Wythen Baxter published his famous 'Tne Book of the Bastiles' - a somewhat lurid
compilation of newspaper reports, court proceedings, correspondence and so on, which graphically
illustrated some of the horror stories relating to the New Poor Law. For example: An enquiry has
taken place this week at Rochester, before the county magistrates, into several charges preferred
against James Miles, the master of the Hoo Union-House, for cruelly beating several young pauper-
children of both sexes. Elizabeth Danes stated that she was 13 years of age, and that the defendant,
James Miles, had punished her three times while she was in the Union-House. The offence she had
committed was leaving a little dirt in the corner of a room, and the defendant made her lie upon a
table, and took her clothes off, and beat her with a birch-broom until blood came. Two years later, in
1843 the satirical magazine 'Punch' reported how in Bethnal Green "An infant, only five weeks old,
had been separatedfrom the mother, being occasionally brought to her for the breast, "(b)
Er was ook nog de mogelijkheid om armen niet binnen het workhouse zelf onder te brengen, maar aan
particulieren uit te besteden. Zij kregen hiervoor inruil een vergoeding. Dat dit zgn. 'farming the poor'
uitnodigde tot misbruik ligt wel heel erg voor de hand.
Dickens verwijst hiernaar in hoofdstuk II van Oliver Twist:
Met het basisidee in gedachte, dat armen van het allereerste moment dat ze om
hulp aanklopten als verdachten en oplichters werden beschouwd, is het niet
vreemd dat het personeel in deze instellingen zich uiterst streng en achterdochtig
opstelde en dat misstanden en misbruik regelmatig voorkwamen. In Oliver is dat
Mr. Bumble, de beadle. Volgens The Concise Oxford Dictionary is een beadle: a
minor parish officer dealing with petty offenders; iemand die zich dus met kleine
overtredingen bezig hield. Oliver werd dan ook eerste en vooral als een lastpost en
een boefje gezien.
Het kan niet anders of een wet die zich zo negatief opstelt tegenover armen en
hulpbehoevenden moet vanaf haar introductie ook veel verzet hebben opgeroepen.
Die oppositie kwam ook niet alleen van de aller minsten.
