Het eerste rapport zet de problematiek en wantoestanden uiteen, verbonden aan
het 'bail system' van het Mesne Process. De commissioners wilden echter wel de
procedures vereenvoudigen, maar niet het Mesne Process afschaffen. Het naast elkaar
bestaan van insolventie en bankroet kwam niet aan de orde.
Inmiddels bleven de gevangenissen voor schuldenaren van Londen overvol. Een
bestuurder van die stad, de Alderman Wood, en mr.Hume M.P., stelden een onderzoek
in. Zij bezochten zowel de gevangenissen als die rechtbanken, die vnl. kleine schulden
behandelden. Zij rapporteerden, dat handelaren door colportage bewust vele
hardwerkende arbeiders tot schulden verleidden, die eindigden met gevangenschap
wegens schuld of met het werkhuis.
They found.... that the practice of the tally creditors, or those who receive payments
for goods by the week, was that against which humane legislation ought to be most
particularly directed. It is as follows: - A shopkeeper sends out a servant to inquire
into the circumstances of the industrious poor of the neighbourhood. As soon as it has
been found that a hard-working man is regularly employed, the tally-man throw's
himself in the way of the poor fellow's wife, and displaying a beautiful shawl, or other
articles of finery, tells her that the price shall come quite easy, as he will take it at 2s.
or 1 s. 6d. per week. She is led by this proposal into still greater expenses, and at length
the tallyman arrests her husband in the midst of his labour, and makes him the inmate
of Whitecross-street prison, or of the Borough compter. The habits contracted in those
places of confinement are such as disqualify the unfortunate debtor for any
industrious employment, and his wife and children inevitably become a burden to
the parish. The husband finding that those who were before dependent upon him
can live without his assistance, becomes confirmed in idleness and debauchery, and
the respectable payers of rates and taxes are pushed for the means of supporting
the miserable creatures thus reduced to a horrible state of poverty.... We understand
that Mr.Hume and Alderman Wood intend to bring in a bill early next session, to
disallow imprisonment for small debts.[Imprisonment for Small Debts. The Times

Mr.Hume bracht deze bevindingen naar voren in het House of Commons op 9
Februari 1830 en wenste nader onderzoek. De regering vond, dat dit onderzoek een
onderdeel moest zijn van de Commission on the Superior Courts of Common Law. In de
opdracht, die deze commissie op 10 maart 1830 voor haar vierde rapport meekreeg,
vindt men dit terug.
Het Fourth Report Superior Courts of Common Law 1832 telt 45 bladzijden en een
aantal bijlagen met schriftelijk en mondelinge enquêtes. Het is daarmee een grondige
beschouwing geworden van de Law of Imprisonment for Debt. In de voorgaande
artikelen is er vele malen gebruik van gemaakt.
De commissie zette duidelijk uiteen, wat eraan de Law of Imprisonment for Debt
schortte. Zij concludeerde, dat[p38j:
