Zelfs wanneer iemands schuld in rechte vaststond, was het bij insolventie moeilijk voor de
schuldeiser om verhaal te zoeken op iemands vermogensbestanddelen. Op vermogensbestanddelen
als "annuities, bank notes, bonds, book-debts, copyhold-
land, shares and stock in public funds" kon geen beslag worden gelegd. In een beroemd geworden
redevoering voor het parlement, zei Brougham (later Lord Brougham):
So absurd are our rules in this respect, that if I have borrowed a thousand pounds, and the
creditor has obtained judgment, the Sheriffs officer appointed to levy upon my personalty may
come into my room and take a table or a desk; but if he sees the identical thousand pounds lying
there he must leave it - he touches it at his peril: - 'For this quaint reason,' says Lord Mansfield,
'because money cannot be sold, and you are required by the writ to take your debt out of the
produce of goods sold.'
Things have now changed in the progress of society; trade has grown up; credit has followed its
train; money, formerly only used as counters, has become abundant; banker's accounts have been
invented; paper currency and the funds have been created. Three-fourths of the debtor's
personalty, perhaps nine-tenths, now consists of stock, money and credit; and the rule of law
which leaves
those out of all execution, no longer can mean as before - 'Let all his personalty be liable' - but
let a tenth-part of it only taken. - Can there be a greater change effected upon, or a greater
violence done to, the old law itself, than you do by affecting to preserve its letter? (2)
In 1832 omschreef een parlementaire commissie deze vermogensbestanddelen als volgt:
The creditor may have execution against all moveable goods of the debtor, but he cannot have
execution against copyhold lands, or more than half of the profits of the freehold of the
defendant, or against stock in the public funds, or bonds, bills of exchange or other securities, or
any debts due to the debtor. (3)
The Pickwick Papers'. Het is onduidelijk, waarvan mr.Pickwick leeft. Hij woont in pensions en
herbergen. Roerende goederen heeft hij niet, ook geen meubilair van enige betekenis. Hij leeft
kennelijk van 'stocks, money and credit' en moet 'banker's accounts' hebben. Mrs. Bardell en haar
attornies, Dodson and Fogg, hebben dus geen objecten om hun vorderingen op te verhalen, zonder
de medewerking van Mr.Pickwick. Diens medewerking trachten zij af te dwingen door hem voor
zijn schulden te gijzelen, zó lang tot hij zal meewerken. Op een vraag van een parlementaire
commissie werd in 1832 geantwoord, dat men niet zou weten, hoe je anders iemand kon dwingen
zijn crediteuren te betalen. Mr.Pickwick komt dan ook
vrij, doordat hij betaalt (ch47).
Was iemand echter bankroet verklaard en was voor de afwikkeling een Commission of Bankrupt
benoemd, dan werd een rigoreus onderzoek ingesteld naar al zijn vermogensbestanddelen. Zijn
winkel en huis mochten worden opengebroken en al zijn eigendommen mochten in beslag worden
genomen. Vermogens
bestanddelen, die bij insolventie niet in beslag konden worden genomen, vielen bij bankroet onder
de bevoegdheid van de commissarissen (assignees) om hen te gelde te maken.
