There are six or eight - I forget the exact number - sheriffs officers under the Sheriff of
Middlesex. Their appoint are so good - the business of capturing debtors is so profitable - that
each one who is appointed has to give security to the amount of ten thousand pounds.The
popular superstition is, that all sheriffs officers are Jews. This, however, is a fable. Of those who
hold these situations only two are Jews and one of the others is a woman. It must not, however,
he imagined that these sheriffs officers go themselves to take debtors captive. They are wealthy,
keep their broughams, live in highly respectable streets, and give dinner parties. They do no more
do the execut-ive part of their business than Baron Rothschild carries his own banknotes and
cheques to the Bank of England. The taking of men's bodies is left to the sheriffs officers. Of
these, every sheriff s officer has a certain number. When an attorney is determined to do his
worst upon a creditor, he puts the execution, or capias, into the hands of a sheriffs officer - each
of the latter has a certain number of the larger firms of solicitors who employ him, and not his
fellows; these lawyers he, curiously enough, talks of as his 'clients' who direcdy hands it to one of
his men. The latter gets a guinea for an ordinary capture, but there are instances when that fee
has been increased a hundred-fold. The lady sheriffs officer is the widow of a defunct officer -
amongst themselves they always use the word 'officer', without the prefix - who on the death of
her husband was allowed to carry on the business upon giving the required security." (Voor de

De sheriffs en hun beambten stonden herhaaldelijk voor de vraag of zij de juiste persoon voor zich
hadden. Vergisten zij zich, dan konden zij zelf gedagvaard worden voor schade tengevolge van een
verkeerde aanhouding of gevangenname. Waren zij onvoorzichtig, dan ontsnapte de gedaagde door
een valse naam op te geven. Een dagvaarding voor schade tengevolge daarvan (schuld oninbaar) kon
volgen. Een van de problemen voor de sheriff was de identificatie van de arrestant. Deze moeilijke
positie van de sheriff kwam o.m. naar voren in verband met het z.g. 'Privilege of Parliament'. De
privileges van parlementsleden waren uitgebreid en niet nauwkeurig beschreven. Wat zij inhielden
was een zaak van het parlement en niet van de rechters. Blackstone achtte deze vaagheid van
wezenlijk belang.
Privilege of parliament was principally established, in order to to protect it's members not only
from being molested by their fellow-subjects, but also more especially from being oppressed by
the power of the crown. If therefore all the privileges of parliament were once to be set down
and ascertained, and no privilege to be allowed but what was so defined and determined, it were
easy for the executive power to devise some new case, not within the line of privilege, and under
pretence thereof to harass any refractory member and violate the freedom of parliament. The
dignity and independence of the two houses are therefore in great measure preserved by keeping
their privileges indefinite.
De 'breach of privilege' kwam herhaaldelijk in het parlement aan de orde, zoals op 14 april 1814.
Sir C.Hamilton klaagde toen in het House of Commons, dat hij door Daniel Butler, een beambte
van de sheriff, was gearresteerd. Deze had de opdracht John Charles Hamilton te arresteren.
Ofschoon spreker en zijn bedienden, betoog-den, dat spreker Charles Hamilton heette en niet John
Charles, werd Sir C.Hamilton gearresteerd en opgesloten. Hij kwam echter door toedoen van zijn
attorney (een gevolmachtigd raadsman) spoedig vrij. Het House of Commons besloot hierop Butler
te horen. Deze bleek wel te weten dat hij moest arresteren, maar kon het arrestatie-bevel zelf niet
lezen. Hij werd door het House of Commons veroordeeld tot opsluiting in Newgate. Op 20 april
