indeed of success, are rendered very greaf in consequence of the expense
and trouble attending the inquin/ after character and responsibility, and the
vigilance necessary to the detection of their schemesCases of this kind
are so numerous, that the Judges keep books, in which they enter the
names and addresses of suspected persons who tender themselves as bail.
Connected with this practice of giving queer bail is that what is called
'buffing' bail. One of the company of pettifoggers finds it easy to produce a
witness, who, although he never hcd the notice in his hand, is ready to swear
that he has served the notice of justification of bail. This fellow is called the
'Buffer'The pettifoggersused to employ the 'buffers' to serve a return
by sticking a fishinghook in it, tied to a piece of thread, and shoving it under
the hall-door; no sooner was this done than up walked another buffer to the
door and fished out the notice, so that the defendant escaped without the
necessity of justification [as no opposition appeared upon the case].
Wij moeten bij het citaat uit The Pickwick Papers aan het begin van deze
paragraaf, twee kanttekeningen plaatsen. Ten eerste, de sham-bail (waarover
het hier gaat) kon alleen optreden bij het Mesne Process en wel tussen de bail
below en de bail above. Bij Mr.Pickwick ging het om een final execution. De
'lame man' kon natuurlijk niet weten of Mr.Pickwick al dan niet i.v.m. met een
final execution bij Serjeant's Inn verscheen en hem aanspreken in de hoop, dat
het nog een Mesne Process was. Dat Mr.Pickwick, die van deze procedures
weinig wist, ten onrechte dacht, dat deze bail in zijn plaats gevangen zou
gaan zitten, is begrijpelijk. Wèl begreep hij terecht, dat een dergelijke bail een
meineed pleegde, nl. door onder ede te verklaren, dat hij voldoende
draagkrachtig was om de schuld te betalen.
De tweede kanttekening, dat Perker, de solicitor van Mr.Pickwick, zei, dat
het hier om een legal fiction ging. Wij zagen, dat de sham-bail heel gebruikelijk
was, maar in rechte verwerpelijk. Er werd vnl. niet tegen opgetreden door
gebrek aan oppositie. De sham-bail was echter geen door de rechtbanken
opgestelde constructie om een bepaalde juridische gang van zaken mogelijk
te maken. Hier zit Perker ernaast: het was een gebruikelijke fictie, een 'legal
fiction' was een door de rechtbanken opgestelde fictie.
